These terms govern the use of the azdw software ("azdw") and of the azdw product page. azdw is proprietary, closed-source software distributed in binary form only. By installing or using azdw, or by purchasing a license, you agree to these terms and to the End User License Agreement (EULA) that ships with the software; the EULA prevails over this page where the two differ.
Evaluation: You may use azdw free of charge for evaluation and testing for up to 30 consecutive calendar days. Any use beyond the evaluation period — including internal company use, production deployments or commercial use — requires a paid commercial license.
Commercial license: Licenses are granted per organization (legal entity), not per user, in tiers based on the organization's total headcount as stated on the product page and in the pricing terms shipped with the software. A license covers all components of azdw (library, CLI, MCP server, PowerShell module, Web UI and API service) for internal use within the licensed organization. Resale, redistribution, integration into third-party products and offering azdw as a hosted or SaaS service to third parties are not permitted unless agreed in writing (Managed / BYOC add-on or a separate agreement).
Subscription term and updates: A commercial license is an annual subscription. During the subscription year you receive all updates and new versions and support as described in the Support Policy. Whether a subscription renews automatically is shown in the checkout; a renewal can be cancelled at any time before the renewal date. After the subscription ends you keep a perpetual license to use the last version you received during the subscription (perpetual fallback license), without further updates.
Purchases via Paddle: Commercial licenses are sold through Paddle. For these purchases Paddle.com Market Ltd. (or the Paddle entity named in the checkout) is the merchant of record and your contractual partner for the purchase, invoicing and taxes; Paddle's buyer terms apply to the checkout in addition to these terms. Enterprise licenses and the Managed / BYOC add-on are quoted individually by e-mail.
Business and consumer use: azdw is intended for use by organizations and professionals. If you nevertheless purchase as a consumer, the mandatory consumer protection provisions of your country of habitual residence apply in addition to these terms, including your statutory right of withdrawal for digital content as explained in the Refund Policy.
Optional AI integrations: azdw's core collection, query, relationship, visualization and reporting functions do not require artificial intelligence. AI-assisted features are optional and operate only when you select and configure an AI provider and, where available, a model, or when you make azdw available as a tool to an external AI agent. Selected content is then sent from your environment to the endpoint you configured; I do not receive that content or operate the selected provider or model on your behalf. The provider's terms and privacy policy apply separately.
AI configuration, output and human oversight: AI output is generated by the provider and model you select and is influenced by your prompts, data, permissions, settings and instruction or skill files (including AGENTS.md). It is probabilistic and may be inaccurate, incomplete, outdated, biased or unsuitable. AI output is not a statement by me or professional advice. You must verify the source data and output, maintain meaningful human oversight, and review the scope and effect of every proposed change before approving or using it. Do not rely on AI output as the sole basis for a decision that has legal or similarly significant effects on a person.
AI Act and permitted use: azdw is not designed or intended to make or recommend decisions on recruitment or selection, terms of employment, promotion or termination, to allocate work based on a person's behaviour or personal characteristics, or to monitor or evaluate worker performance. It must not be used for a practice prohibited by Article 5 of Regulation (EU) 2024/1689 (EU AI Act). Before using an optional AI feature in a regulated or high-risk context, you must assess the intended use and your role and obligations under applicable law, ensure that affected personnel have sufficient AI literacy, provide required information to affected persons, and implement appropriate human oversight, data governance, logging and impact assessments. The legal classification of a deployment depends on its actual purpose and use; these terms do not replace or exclude obligations that the EU AI Act or other mandatory law assigns to either party.
Your data and third-party services: You are responsible for ensuring that you are entitled to process and send the selected data to the configured AI provider, for choosing an appropriate provider, model, region and retention settings, and for complying with the provider's terms. In particular, do not send personal, confidential or special-category data unless you have a lawful basis, have given any required notices, and have appropriate processor and international-transfer arrangements in place.
Warranty: The statutory warranty rights of consumers — in particular §§ 327 ff. BGB for digital products — remain unaffected. Beyond these statutory rights, I do not guarantee that azdw will be error-free, uninterrupted or suitable for a particular purpose of yours, or that AI-generated output will be accurate, complete or fit for a decision or action. azdw accesses your Azure DevOps and GitHub data only with the credentials and permissions you configure; you remain responsible for those credentials and for reviewing changes before approving them.
Limitation of Liability: I am liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act and where I have assumed a guarantee. In cases of slight negligence I am liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), limited to the foreseeable damage typical for this type of contract and, towards business customers, to the license fees paid for the current subscription year. Any further liability is excluded.
Governing Law and Jurisdiction: These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Erlangen, Germany.

The person named above is the controller within the meaning of the General Data Protection Regulation (GDPR).
I process personal data only to the extent necessary for operating the azdw product page, informing wait-list subscribers, selling and supporting licenses, and understanding the adoption of the software. Data is shared only in the cases described below. The azdw software itself never reads, transmits or stores your work items, queries, file contents, credentials, tokens or organization URLs on my behalf; a separate privacy notice with the same content ships with the software.
Processed Data: IP address, browser type/version, operating system, access time, log files.
Purpose: Provision, stability, and security of the website (e.g., protection against misuse).
Legal Basis: Art. 6(1)(f) GDPR (legitimate interest in IT security and functionality).
Recipient / Hosting: Microsoft Azure (EU/Northern Europe region, e.g., Dublin).
Retention Period: Server log files are deleted after a maximum of 30 days.
Processed Data: Your e-mail address; the perspective you selected on the product page (enterprise or freelancer); the date and time of your request; the exact consent text you agreed to and its version; the page you used; and — as proof of your consent — the IP address and browser identification (user agent) transmitted with your request.
Purpose: To send you a single e-mail when azdw becomes publicly available (including where and how to obtain it and the pricing). The address is used for no other purpose, is not added to any newsletter and is not passed on to third parties.
Legal Basis: Art. 6(1)(a) GDPR — your consent, which you declare by submitting the wait-list form on the product page after reading the consent notice shown next to it (single opt-in). The consent text, time, IP address and user agent are stored so that the consent can be evidenced (§ 7 (2) no. 2 UWG). You may withdraw your consent at any time with effect for the future by e-mail to support@thomas-gossler.de; your address is then deleted immediately.
Recipients / Processors: Microsoft Azure (Azure Storage table and the website's serverless API, EU region) under Microsoft's data processing terms (Art. 28 GDPR); the e-mail provider used for the notification (see d).
Retention Period: Until the release notification has been sent to all subscribers; the wait list, including all data listed above, is deleted right after that single e-mail has gone out, and in any case no later than 30 days after the public release of azdw. On withdrawal the data is deleted immediately.
Processed Data: Program version and UTC timestamp; the startup mode (CLI, MCP server, AI chat, etc.); a two-letter country code derived offline from your operating system's regional settings (your IP address is not used or transmitted for this purpose); stable, salted one-way hashes (SHA-256) of the machine and user name, from which the original values cannot be recovered; counts of configured connections by platform (no URLs, names or credentials). At most one data point per run, throttled to one per ten minutes per installation. Work items, queries, file contents, credentials, tokens, URLs, e-mail addresses, user names, host names and IP addresses are never collected.
Purpose: Understanding adoption, reach and approximate unique-user counts in order to improve the software.
Legal Basis: Art. 6(1)(f) GDPR (legitimate interest in understanding and improving the product with data that is de-identified by design). A one-time notice is shown on the first genuine run. You can minimize telemetry to the program version and a timestamp at any time by setting the environment variable AZDW_MINIMIZE_TELEMETRY=1; telemetry is disabled entirely in development builds.
Recipient: Microsoft Azure (EU region).
Retention Period: Telemetry data is retained for up to 24 months in aggregated form; raw data points are deleted after 12 months.
Processed Data: E-mail address, name and company (if provided), country, postal code, VAT identification number (business customers), payment information, transaction metadata, license tier and term.
Purpose: Execution of the purchase contract, issuing and managing the license, invoicing, and legal retention requirements.
Legal Basis: Art. 6(1)(b) GDPR (contract), Art. 6(1)(c) GDPR (legal retention obligations).
Recipient: Paddle as merchant of record (independent controller for the checkout and payment data); tax authorities where required. azdw does not perform online license activation; no license server is contacted by the software.
Retention Period: Accounting/tax data must be retained for 10 years (in accordance with AO/HGB); other license data for the duration of the license and up to 12 months after expiration.
Processed Data: E-mail address, optional name, contents of your inquiry; for issues filed in the public issue tracker after the release, the account name and content you choose to publish there.
Purpose: Handling support, quote and contact requests.
Legal Basis: Art. 6(1)(b) GDPR (pre-contractual measures/contract) or Art. 6(1)(f) GDPR (legitimate interest in efficient communication).
Recipient: Email provider (Google Mail, Google Ireland Ltd.; any transfer to the USA is based on the EU–US Data Privacy Framework or the EU standard contractual clauses); GitHub, Inc. (USA, Data Privacy Framework) for issues you file in the public issue tracker.
Retention Period: Up to 2 years after the request has been completed; public issues remain public.
Processed Data: Technical usage data of the website (pages viewed, referrer, browser and device type, performance and error data), possibly truncated IP addresses, pseudonymous identifiers.
Purpose: Stability, performance and usage analysis of the website.
Page-use tracking is provided by the hosting platform (Azure Static Web Apps) and is activated only if you consent via the website banner.
Legal Basis: Depending on your choice in the cookie banner (see section Cookies & Consent Management): Art. 6(1)(a) GDPR (consent) if you agree by clicking "OK"; Art. 6(1)(f) GDPR (legitimate interest) for strictly technically necessary measurements only.
Recipient: Microsoft Azure (EU).
Retention Period: 90 days, then automatically deleted.
Processed Data: When a YouTube video is loaded: IP address, browser data, the video watched and interaction data, and cookies or comparable identifiers set by YouTube.
Purpose: Showing the azdw product tour video.
Legal Basis: Art. 6(1)(a) GDPR. The video is embedded in YouTube's privacy-enhanced mode (youtube-nocookie.com) and is loaded only after you have accepted the cookie banner or clicked "Load video"; until then no connection to YouTube is made. The 30-second teaser is served from this website and involves no third party.
Recipient: Google Ireland Ltd. (YouTube); data may be transferred to Google LLC in the USA on the basis of the EU–US Data Privacy Framework.
Retention Period: According to Google's privacy policy.
When you first visit, a notification banner will appear. You have the following options:
Legal Basis: Art. 6(1)(a) GDPR (consent), if you click "OK". Without your consent, no analytics/error tracking via Application Insights takes place.
You can change or withdraw your decision at any time with effect for the future: reset your cookie choice. Your choice is stored in your browser's local storage; alternatively, clear this site's data in your browser. The banner will then reappear.
Your consent choice is stored for a maximum of 12 months, after which you will be asked to make a new decision.
Under Articles 15–22 GDPR you have the following rights: access, rectification, erasure, restriction of processing, data portability, and objection to processing based on Art. 6(1)(f) GDPR. To exercise these rights, simply send an email to support@thomas-gossler.de.
Where processing is based on your consent — in particular the wait list — you may withdraw that consent at any time with effect for the future (Art. 7(3) GDPR); the lawfulness of processing before the withdrawal is not affected.
You have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates the GDPR. The competent authority in Bavaria is:

I protect data through appropriate technical and organizational measures (TOMs), including transport encryption (TLS), encryption at rest for the wait-list storage, access restricted to the controller, and regular security reviews.
I may update this policy to reflect changes in legal requirements or technical developments. The current version is always available at this address.
Support for azdw is provided on a best-effort basis by e-mail to support@thomas-gossler.de and, after the public release, through the public issue tracker linked on the product page, where you can file bugs and enhancement requests.
Holders of a valid commercial subscription receive priority handling of reported issues and feature requests. Response and resolution times are not guaranteed; dedicated support terms can be agreed for Enterprise licenses and the Managed / BYOC add-on.
For efficient support, please include the azdw version (azdw --info), your platform, the command or tool call used and the observed behavior. Never include credentials, tokens or work-item content in support requests.
azdw can be evaluated free of charge and without functional limitations for 30 consecutive calendar days before any purchase is required. This evaluation period is intended to give you ample opportunity to verify that azdw works in your environment and meets your needs.
After a purchase, refunds are therefore not granted as a rule. As an exception, if within 14 days of your first purchase azdw cannot be installed or run on a supported platform for technical reasons that support is unable to resolve, the subscription will be refunded in full through Paddle. Renewal payments can be avoided by cancelling before the renewal date; pro-rata refunds for unused parts of a subscription year are not offered.
If you are a consumer, your statutory right of withdrawal (14 days, § 355 BGB) and your statutory warranty rights remain unaffected; please note that the right of withdrawal for digital content expires early if you expressly agree in the checkout that the license is delivered immediately and acknowledge the loss of that right. Business customers have no statutory right of withdrawal.
