Terms of Service

By using my software applications and services, you agree to the following terms and conditions.

The applications are intended solely for personal use.

azdw, the work-item and portfolio tool for Azure DevOps and GitHub, is licensed to organizations for internal business use and has its own terms: see the azdw legal page. Where that page is silent, this page applies.

License: You are granted a non-exclusive, non-transferable license to use the applications on a number of devices as specified in the license within your personal work and home contexts, subject to compliance with these terms and applicable laws. By purchasing the software you agree to the terms of service and privacy policy.

For auto-renewing subscriptions purchased through Apple, the Apple Standard Terms of Use (EULA) also apply.

Warranty: The statutory warranty rights of consumers — in particular §§ 327 ff. BGB for digital products — remain unaffected. Beyond these statutory rights, I do not guarantee that the applications will be error-free, uninterrupted or suitable for a particular purpose of yours.

Limitation of Liability: I am liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act and where I have assumed a guarantee. In cases of slight negligence I am liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

Governing Law and Jurisdiction: These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Erlangen, Germany.

The person named above is the controller within the meaning of the General Data Protection Regulation (GDPR).

2. General Information

I process personal data only to the extent necessary for operating this website, managing software licenses, and handling purchases. Data will only be shared in the cases described below.

3. Processing Activities

a) Operation of the Website

Processed Data: IP address, browser type/version, operating system, access time, log files.

Purpose: Provision, stability, and security of the website (e.g., protection against misuse).

Legal Basis: Art. 6(1)(f) GDPR (legitimate interest in IT security and functionality).

Recipient / Hosting: Microsoft Azure (EU/Northern Europe region, e.g., Dublin).

Retention Period: Server log files are deleted after a maximum of 30 days.

b) Use of the Software (License Verification)

Processed Data: Device ID (pseudonymized), encrypted email address.

Purpose: License management, prevention of misuse.

Legal Basis: Art. 6(1)(b) GDPR (performance of a contract).

Recipient: Microsoft Azure (EU/Northern Europe region, e.g., Dublin).

Retention Period: For the duration of the active license and up to 12 months after expiration.

c) Purchase Processing

Processed Data: Email address, country, postal code, payment information, transaction metadata, and purchase channel.

Purpose: Execution of the purchase contract, invoicing, and legal retention requirements.

Legal Basis: Art. 6(1)(b) GDPR (contract), Art. 6(1)(c) GDPR (legal retention obligations).

Recipient: Depending on the purchase channel: Paddle (direct web purchases; independent controller), Apple (App Store / In-App Purchase processing; independent controller), tax authorities.

Retention Period: Accounting/tax data must be retained for 10 years (in accordance with AO/HGB).

d) Communication (Support)

Processed Data: Email address, optional name, contents of your inquiry.

Purpose: Handling support and contact requests.

Legal Basis: Art. 6(1)(b) GDPR (pre-contractual measures/contract) or Art. 6(1)(f) GDPR (legitimate interest in efficient communication).

Recipient: Email provider (Google Mail, Google Ireland Ltd.; any transfer to the USA is based on the EU–US Data Privacy Framework or the EU standard contractual clauses).

Retention Period: Up to 2 years after the request has been completed.

e) Analytics / Error Tracking (Microsoft Azure Application Insights, if enabled)

Processed Data: Technical usage data; possibly truncated IP addresses; pseudonymous identifiers.

Purpose: Stability, performance, and error analysis of the application.

By default, no analytics or advertising tracking is enabled. Application Insights is only activated if you consent via the website banner or another app-specific opt-in.

Legal Basis: Depending on your choice in the cookie banner (see section Cookies & Consent Management):

Recipient: Microsoft Azure (EU).

Retention Period: 90 days, then automatically deleted.

f) Optional Ad-Supported Usage (Google AdMob, if you opt in within an eligible app)

Processed Data: Advertising ID or comparable device/app identifiers, IP address, approximate location derived from IP, app interaction data, ad impressions, diagnostic data, and fraud-prevention signals.

Purpose: Delivery of ads, financing optional lower-cost or free app usage, fraud prevention, frequency capping, aggregated measurement, and billing.

Legal Basis: Art. 6(1)(a) GDPR (consent / voluntary opt-in to an ad-supported mode), where required. In addition, Google may process certain data under its own responsibility for non-personalized ads and service operations.

Recipient: Google AdMob / Google; see the Google Privacy Policy and How Google uses information from sites or apps that use its services.

Retention Period: According to Google policies and the configuration of the respective app.

Even if you disable personalized ads or opt out of ad personalization, Google may still process certain data for non-personalized ads, fraud prevention, frequency capping, aggregated reporting, and billing. If you choose such an ad-supported option, Google's own terms and privacy information also apply.

When you first visit, a notification banner will appear. You have the following options:

Legal Basis: Art. 6(1)(a) GDPR (consent), if you click "OK". Without your consent, no analytics/error tracking via Application Insights takes place.

This website banner controls website analytics only. Any optional ad-supported mode inside an app is decided separately within the app and may involve Google AdMob under Google's own terms and privacy rules.

c) Withdrawal / Change of Your Choice

You can change or withdraw your decision at any time with effect for the future: reset your cookie choice. Your choice is stored in your browser's local storage; alternatively, clear this site's data in your browser. The banner will then reappear.

d) Cookie Lifetime

Consent cookies (consent status) are stored for a maximum of 12 months, after which you will be asked to make a new decision.

5. Your Rights

Under Articles 15–22 GDPR you have the following rights: access, rectification, erasure, restriction of processing, data portability, and objection to processing based on Art. 6(1)(f) GDPR. To exercise these rights, simply send an email to support@thomas-gossler.de.

Where processing is based on your consent, you may withdraw that consent at any time with effect for the future (Art. 7(3) GDPR); the lawfulness of processing before the withdrawal is not affected.

6. Right to Lodge a Complaint with a Supervisory Authority

You have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates the GDPR. The competent authority in Bavaria is:

7. Data Security

I protect data through appropriate technical and organizational measures (TOMs), including transport encryption (TLS), access restrictions, and regular security reviews.

8. Changes to this Privacy Policy

I may update this policy to reflect changes in legal requirements or technical developments.

Support Policy

I'm committed to providing support for my applications, though it is subject to availability. Support is primarily provided through GitHub issues, where users can categorize their queries as either bugs or enhancement requests.

While I strive to address all issues promptly, please understand that response times may vary. I do not guarantee resolution times or outcomes, but I will make every effort to assist you.

For efficient support, please ensure your issue reports are detailed and include all necessary information to reproduce any bugs. For enhancement requests, please provide a clear description of the desired functionality.

Refund Policy

In accordance with German consumer protection law, please note that all users are automatically enrolled in a 14-day trial period during which the software can be tested extensively without any limitations. A purchase is only required after this trial period has ended.

As such, after payment is made following the trial period, no refund requests will be accepted. This policy is in place to ensure that customers have ample opportunity to evaluate the software before committing to a purchase.

Please note that this refund policy does not affect your statutory rights under German consumer protection law.
